Welcome to Happy Hour Charter. These Terms and Conditions (“Terms”) govern your use of our website and charter services. By booking a charter or using our website, you agree to these Terms.

2. Eligibility

You must be at least 18 years old to book a charter

The booking party assumes responsibility for all guests

3. Booking & Payment Terms

Reservations require a deposit or full payment to secure your charter
Pricing varies based on charter type, duration, and add-ons
Payments are processed securely through third-party providers
By submitting payment, you authorize the charge and agree not to initiate fraudulent chargebacks

4. Cancellation & Refund Policy

Cancellations must be made at least [48–72 hours] in advance for a refund
Late cancellations may result in partial or full forfeiture
No-shows are non-refundable

Weather Policy:

Charters operate rain or shine
If conditions are deemed unsafe by the captain, you will be offered:
- Rescheduling OR
- Refund at our discretion

5. Charter Rules & Guest Responsibilities

By booking, you agree that:

All guests will follow captain instructions at all times
No illegal drugs or unlawful behavior are permitted
Excessive intoxication or unsafe conduct may result in immediate termination without refund
Guest count must not exceed vessel capacity

6. Captain Authority

The captain has full authority to:

Cancel or end the charter for safety reasons
Adjust routes due to weather or conditions
Enforce all boating and safety regulations

This is standard in charter agreements and required for liability protection

7. Liability Waiver & Assumption of Risk

By participating in a charter, you acknowledge:

Boating activities involve inherent risks, including injury, weather conditions, and water hazards
You voluntarily assume all risks associated with participation

Happy Hour Charter is not liable for:

Personal injury, illness, or death
Lost, stolen, or damaged personal belongings
Delays or cancellations due to weather, mechanical issues, or unforeseen events

8. Damage & Cleaning Policy

The booking party is financially responsible for any damage caused by guests
Additional cleaning or repair fees may be charged if necessary

9. Arrival & Timing

Guests must arrive on time for their scheduled charter
Late arrivals may result in reduced charter time without refund

10. Prohibited Conduct

You may not:

Engage in illegal activity
Bring prohibited items onboard
Harass crew or other guests
Violate safety rules

We reserve the right to refuse service or terminate a charter at any time.

11. Website Use

By using our website, you agree:

Not to misuse, copy, or exploit content for commercial purposes
Not to attempt to disrupt or interfere with site functionality
